Loan and Retail Credit Terms and Conditions

ENTERING THIS AGREEMENT MEANS THAT:

YOU MUST

  • Inform us if you change your name, address or telephone number within 14 days
  • Make sure that the payment is sent or delivered, if we have agreed to collect the repayment and the representative does not call

AS A RESULT

  • All notices and statements given to you in person or left at or sent to your address as provided to us, or your present or last known address shall be considered validly given. If sent by first class post they have been considered received by you 48 hours after posting.
  • If two or more people are named as the customer, the liability of each shall be joint and several. This means that each person can be fully responsible for the responsibilities set out in this agreement.
  • The signature to this agreement acknowledges:
    • That you received prior to signing this agreement the Pre Contract Information
    • That you received a true copy of the agreement

YOU MAY

  • Repay the loan at any time
  • In the event of early settlement you are entitled to a rebate calculated under the Consumer Credit (Early Settlement) Regulations.

YOU AGREE

  • To pay the company in instalments as set out in the agreement
  • To an agent calling on you in your home to collect your payment(s)
  • To the company making a credit reference and fraud prevention agency search with other creditors
  • That the company may disclose to such agencies how you conduct your account
  • If you default or are suspected of fraud that other lenders may us this information about you and others with whom you are financially linked for credit assessment, debt tracing, fraud and money laundering prevention

YOU HAVE A RIGHT

  • To receive on request and free of charge, under section 77B of the Act, a statement in the form of a table showing:-

A) The details of each instalment owing under the agreement

B) The date on which each instalment is due, the amount and conditions relating to the payment of the instalment

C) A breakdown of each instalment showing how much comprises

i) Capital Repayment

ii) Interest Payable, and

iii) If applicable any other charges

YOUR DATA may be used by us and others

  • For purposes for which you give your specific permission
  • In very limited circumstances, when required by law or when permitted by the Data Protection Act 1998
  • To manage your account
  • Make collections
  • For statistical purposes, surveys and research (we may contact you via email, telephone or via the internet).
  • If we transfer, change or assign this agreement to a third party or if we use a third party to manage any aspect of this agreement we will pass your info to them,
  • And this may remain on your file for six years after they are closed, whether settled by you or defaulted

WE MAY

  • Allow another person to take over all or part of the agreement. That person will then take over all rights and responsibilities under this agreement
  • End the agreement, after giving any written notice required by 1a if:
    • You fail to keep to this agreement
    • You commit an act of bankruptcy (such as failing to pay a debt as ordered by a court)
    • You have given false information in connection with this agreement

As we are required by law to share data with Credit Reference Agencies, poor repayment history could affect your credit rating. In order to qualify for a new or additional loan you must have kept up regular payments on your existing or previous loan. Your Agent will also consider your personal circumstances when discussing a loan with you.
